1. WHAT IS A PRIVACY POLICY AND TO WHOM DOES IT APPLY?

1.1. The Privacy Policy Rules (hereinafter referred to as the “Rules”) regulate the processing of personal data provided by you to UAB Logispace, legal entity code 303203813, Ugniagesių g. 14, Vilnius
(hereinafter referred to as the “Data Controller”), the principles of collecting, processing and storing data when you visit the Data Controller’s website https://logispace.lt (hereinafter referred to as the “Website”), office or social network accounts and perform actions, including, but not limited to: using search options, reading published information, submitting queries through the Website and the specified contacts via email, telephone and social networks, providing and receiving any type of information and/or data, purchasing goods/services (hereinafter referred to as the “Services”).
1.2 The Data Controller determines the purposes and means of processing of your personal data, uses natural and/or legal persons who process your personal data on behalf of the Data Controller and in accordance with its instructions, in compliance with the requirements of the General Data Protection Regulation (hereinafter referred to as the “GDPR”), the Law of the Republic of Lithuania on the Legal Protection of Personal Data, and the requirements for processing of personal data set out in other legal acts.
1.3 Persons under the age of 16 may not submit any personal data through the Website or at the Data Controller’s office. If you are a person who is under the age of 16, you must obtain the consent of your parents or other legal guardians before you provide personal information to the Data Controller.
1.4 By using the Website and the Services, the person agrees to these Terms and Conditions, which set out the purposes and methods of collecting personal data, the conditions for processing and storing personal data, the rights of the data subject, etc., without any reservation or limitation. If you do not agree to these Terms and Conditions, you are not entitled to use any of the Data Controller’s Services (website, social media accounts and/or office).

2. HOW DO WE COLLECT AND USE YOUR PERSONAL DATA?

2.1 Your personal data may be collected in the following ways:
2.1.1. when you come to the Data Controller’s office or remotely (by phone, email, etc.) when using the Data Controller’s Services, when you have signed a contract with the Data Controller for the receipt of the Services and/or when negotiating the provision of the Services prior to the signing of the contract, when you are paying for the Services, or when you are cooperating with us in any other form;
2.1.2. by submitting reviews, comments, likes, mentions and becoming a follower on the Website and/or social networks (Facebook, Instagram, LinkedIn, etc.) belonging to the Data Controller;
2.1.3. by contacting the Data Controller directly through the Website by filling in the enquiry/registration form or the contacts provided and/or by sending messages via social networking platforms;
2.1.3.1. when you submit an enquiry/registration form on the Website, the Data Controller collects and processes your name, email address, telephone number, the subject and the comment/message you have provided in order to respond to your enquiry. These personal data are processed on the basis of the consent expressed by you by an active act of sending the request/registration form. If you do not provide these personal data, the Data Controller will not be able to respond to your request/registration form on the Website.
2.1.3.2. the retention period for personal data contained in enquiries/registration forms is 12 months. If a legal dispute is initiated or is likely to be initiated as a result of the enquiry/registration form, the Data Controller may keep the data for a longer period of time until the expiry of the statutory periods of limitation for lodging a complaint or bringing an action, and/or until the final decision has become final.
2.1.3.3 The Data Controller shall only use the data of the person who submitted the Enquiry/Registration Form for the purpose of properly and objectively processing the Enquiry/Registration Form, providing the necessary information, answering questions, resolving requests or claims. The Data Controller may also analyse the data from the Request in order to improve the quality of its operations and the services provided to you, taking into account your opinions and suggestions.
2.1.3.4 Each person providing information to the Data Controller must also comply with the requirements for the protection of personal information: do not include personal data in the title of either the letter or the enquiry; only include in the text of the letter, enquiry, registration or request the amount of personal data necessary to achieve the purposes for which the message/enquiry/registration is sent.
2.1.4. we use cookies when browsing the Website on any device and through this we can identify the specific device on which you have accessed the Website (you can read the Cookie Policy in the Cookie Notice on the homepage of the Website);
2.1.5. when exchanging business cards with the Data Controller at meetings or events, or when you provide your contact information when registering for the Data Controller’s events;
2.1.6. when you receive from third parties.
2.2 Your personal data is collected for a specific purpose and may not be used for any other purpose without lawful basis or consent. The Data Controller collects and uses personal data accordingly for the following purposes:
2.2.1. to provide the Services that you have subscribed to on the basis of a contract with the Data Controller for the provision of the Services (e.g. storage) and/or on the Website;
2.2.2. to enter into/modify/administer contracts and other documents;
2.2.3. book a time or event in accordance with the booking forms/agreements you have submitted by email;
2.2.4. register for events (e.g. meetings, etc.);
2.2.5. to ensure that the content of the Site is made available for the preferences you have chosen (language and other preferences, and otherwise adapting the Site to you (the visitor));
2.2.6. for administrative purposes (to keep records of visitors who have registered for Site content);
2.2.7. security purposes (e.g. identification of a natural person, identification of a vehicle, etc.);
2.2.8. for marketing purposes, if you have given your explicit consent (you may receive offers from the Data Controller or its partners or requests for evaluation of the quality of the services by email or telephone call). You may opt out of marketing communications at any time of the year by informing the sender by replying to the email;
2.2.9. for the purpose of selling services (where you are or have been a customer of the Data Controller, we are required to store personal data and other information in accordance with the legislation in force in the Republic of Lithuania);
2.2.10 for the purpose of collecting statistics about the use of the Website;
2.2.10.1 The Data Controller is constantly improving its Website and aims to make it as easy as possible for you to use it. To do this, the Data Controller collects data on which information is most relevant to you, how often you access the Website, which browsers and devices you use, what content you read most often, and where you are located. The Data Controller collects this information using the automated Google Analytics tool (for more information about the tool, see https://support.google.com/analytics/answer/1012034?hl=lten&ref_topic=6157800 ).
2.2.10.2 You can disable the collection of data about you by Google Analytics at any time, as described here: https://tools.google.com/dlpage/gaoptout/ or on this website by clicking on the icon at the bottom left and selecting your CONSENT in the settings.
2.2.10.3.Access to traffic statistics is available to the Data Controller’s employees and/or companies working in the fields of IT, sales and marketing, who are responsible for the analysis of this data and the improvement of the Website.
2.2.10.4 For information on the use of cookies to collect statistical information, please refer to Section 7 of this Privacy Policy.
2.2.11. for the smooth operation and security of the Website and for troubleshooting.
2.2.11.1 The server on which the Website is hosted may also record the requests you make to the server (the address of the website you are opening, the device and browser you are using, your IP address and the time of your login). This data is used for technical purposes only, to ensure that the Website functions properly and securely and to investigate possible security breaches.
2.2.11.2 Server record data is collected and used by the Data Controller to ensure the technical availability and security of the Website.
2.2.12. to ensure the smooth operation and security of the Website and to troubleshoot faults
2.2.13. where we are required to provide information to public authorities in accordance with the applicable laws of the Republic of Lithuania.

3. HOW DO WE PROCESS YOUR PERSONAL DATA?

3.1 All your personal data is processed:
3.1.1. on the basis of consent, which is expressed by your active actions, i.e. by contacting the Data Controller and submitting personal data in various forms, or by other active actions in the Website, social networks and/or the Data Controller’s office;
3.1.2. for the pursuit of the legitimate interests of the Data Controller (e.g. to manage and administer the Website, to inform you about the services offered, news, etc.);
3.1.3. to carry out the obligations imposed on the Data Controller by law.
3.2 In accordance with the requirements of the legislation of the Republic of Lithuania, we may process the following Your data:
3.2.1. personal data (name, surname, date of birth, personal identification number, signature, copies of personal documents, bank account number);
3.2.2. contact data (email addresses, residential addresses, telephone numbers, social network accounts);
3.2.3. other data (e.g. vehicle registration number, etc.) that you provide when concluding and executing a contract for the provision of services with the Data Controller;
3.2.4. personal data which the Data Controller needs to process in order to comply with applicable legal obligations;
3.2.5. other data that we collect from lawful sources in the course of providing the Services.

3.3 All of your personal data is processed only to the extent necessary to ensure the proper preparation of responses to inquiries made on the Website and/or social networking platforms, the provision of the Services in accordance with the contracts for the provision of our services, and for the purposes of related purposes, as well as for the fulfilment of the legal obligations to which the Data Controller is bound.

4. TO WHOM DO WE TRANSFER YOUR PERSONAL DATA?

4.1 We transfer your personal data to the following data recipients:

  • UAB Logispace (administration and provision of Services);
  • UAB Interneto Vizija (server and website hosting services);
  • Telia Lietuva, AB (telecommunications and internet services);
  • Bitė Lietuva, UAB (telecommunications and internet services);
  • Google Analytics – Google, Inc. (web analytics service that helps analyse the use of the Website).

5. WHAT RIGHTS DO PERSONAL DATA PROTECTION LAWS GIVE YOU?

5.1 The Data Controller shall ensure the exercise of your rights in accordance with the legislation on the protection of personal data. In accordance with them, you have the right to:
5.1.1. to submit a request to the Data Controller to obtain confirmation as to whether the Data Controller processes data relating to you and, if it does, to request access to the data processed and the information relating to it;
5.1.2. to request the Data Controller to rectify inaccurate or incorrect information used or to supplement it where it is incomplete;
5.1.3. to request the Data Controller to erase the information that the Data Controller holds about you if it is used unlawfully;
5.1.4. to submit a request to the Data Controller to restrict the processing of information held about you – where you contest the accuracy of the data or object to the processing of the data, you object to the erasure of your data processed unlawfully or you need the data to assert, exercise or defend legal claims;
5.1.5. to object to the use of your personal data – where the Data Controller uses your personal data to perform a task carried out in the public interest or in the exercise of a public authority vested in the Data Controller and/or the processing is necessary for the purposes of the legitimate interests of the Data Controller or a third party;
5.1.6. to make a request to the Data Controller to transfer (receive) the data that you have provided to the Data Controller under a service contract or with your consent/expression of consent and that are processed by the Data Controller by automated means, in a commonly used electronic form;
5.1.7. to withdraw the consents given to the Data Controller for the use of information about you – where we use personal data on the basis of your consent;
5.1.8. lodge a complaint with a supervisory authority, in particular in the Member State where you are domiciled or where the alleged breach of the GDPR occurred, and seek judicial remedies.
5.2 In cases where a request/enquiry is made to the Data Controller for data relating to a specific individual, we may only provide the data once we have identified that the data subject is indeed the person whose data is requested. This can be done by presenting a valid identity document in the Republic of Lithuania at the Data Controller’s office;
5.3 All your requests referred to in paragraph 5.1 of the Rules shall be made to the contacts specified in paragraph 5.4 of the Rules. Upon receipt of your request, the Data Controller will immediately implement it (within 1-2 working days correct, remove and within 20 calendar days make available for consultation the personal data collected about you, when you request it in writing).

5.4 All requests shall be submitted to the Data Controller in one of the following ways:

6. CHANGING THE RULES

6.1 The Data Controller may at any time amend, supplement and update the Terms in part or in full, so we recommend that you check that you are familiar with the current version of the Terms (the date of publication of the Terms is always indicated at the end of the Terms) before using the Website.
6.2 Amendments or changes to the Terms shall come into effect from the date of their publication on the Site.
6.3 If you continue to use the Website and the Services of the Data Controller after the addition or amendment of the Rules, you shall be deemed to have accepted the new version of the Rules.
6.4 If any provision of the Terms is held to be invalid or unenforceable, that provision shall not affect the validity and enforceability of the remaining provisions of the Terms.

8.1 The controller shall take appropriate technical and organisational measures to ensure the protection of all data against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access, and against all other unlawful forms of processing.
8.2 All notifications relating to the processing of personal data shall be made to the Data Controller in the manner set out in paragraph 5.4 of the Rules. The Data Controller shall reply in the same form in which the notification or claim was received.
